You must not:
-
misuse the website or attempt to gain unauthorised access to it;

-
interfere with the operation or security of the website;

However, minor differences may occur between product photographs and the actual product, including differences resulting from:
-
screen or display settings;
-
manufacturing updates;
-
packaging changes;
-
colour or material variations;
-
improvements made by the manufacturer.
Such differences will not affect your statutory rights where a product is not as described, is faulty or is otherwise not of satisfactory quality.

5. Wellness and Health Information
Earthing Revolution sells products intended to support general wellbeing and lifestyle use.
Unless expressly stated otherwise on a specific product page, our products and the information provided on our website are not intended to diagnose, treat, cure or prevent any disease or medical condition.
Information appearing on our website, emails, blog articles, social media channels or product literature is provided for general educational and informational purposes and should not be treated as medical advice.
You should seek advice from an appropriately qualified healthcare professional if you have concerns about a medical condition, medication or whether a product is suitable for you.
Please also review our Medical Disclaimer and Medical and Medication Considerations pages before using our products where relevant.
Nothing in this section excludes any legal responsibility that we have for product safety or for goods that do not comply with applicable consumer law.
6. Availability
All products are subject to availability.
Adding an item to your basket does not reserve that item.
We may occasionally be unable to fulfil an order because, for example:
-
an item has unexpectedly sold out;
-
a supplier or manufacturer has discontinued an item;
-
a product has been incorrectly priced or described;
-
we are unable to deliver to the requested destination;
-
we reasonably suspect fraudulent activity.
If we cannot accept your order, we will notify you and refund any payment already taken for the affected item.
7. Placing an Order
When you place an order through our website, you are making an offer to purchase the products in your order.
You will normally receive an automated order confirmation after completing checkout.
Receipt of an automated order confirmation does not necessarily mean that we have accepted your order.
A contract between you and Earthing Revolution Ltd is formed when we confirm that your order has been accepted or dispatched, or when we otherwise expressly accept the order.
If we are unable to accept an order after payment has been taken, we will refund the relevant payment.
Before completing checkout, you will have an opportunity to review and correct your order details.
You are responsible for ensuring that the information you provide to us, including your delivery address and contact details, is complete and accurate.
8. Prices
Prices are displayed in the currency shown on our website and include VAT where applicable unless clearly stated otherwise.
We aim to ensure that all prices are accurate.
If we discover an obvious pricing error after you place an order, we may contact you and give you the option to:
We will not knowingly conceal unavoidable charges or add mandatory charges later in the checkout process in a way that could mislead customers.
Delivery charges, where applicable, will be clearly displayed before you complete your order.
9. Promotions and Discount Codes
From time to time we may offer promotional prices, discount codes, bundles, free gifts or other promotional offers.
Unless otherwise stated:
-
promotions cannot be exchanged for cash;
-
promotional codes may not be combined with other offers;
-
only one discount code may be used per order;
-
promotional offers may apply only to selected products;
-
promotions may have stated start and end dates;
-
promotions are subject to availability.
Where an offer is described as being available for a limited time, that limitation will reflect the genuine terms of the promotion.
We reserve the right to withdraw or correct a promotion where there has been an obvious error, technical problem, misuse or fraud.
This does not affect orders that we have already accepted unless legally permitted.
10. Payment
We accept the payment methods shown during checkout.
Payment is processed through secure third-party payment providers.
You must have permission to use the payment method submitted with your order.
We do not store complete payment card details ourselves where payment information is processed by our payment providers.
We may carry out reasonable fraud-prevention or payment-verification checks before accepting or dispatching an order.
11. Delivery
Delivery options, charges and estimated delivery times will be displayed on our website or during checkout.
Unless we have agreed a different delivery period with you, goods will normally be delivered within 30 days of the contract being formed.
Delivery dates and estimates are not guaranteed unless expressly stated.
If there is a significant delay, we will contact you where reasonably possible.
Your legal rights relating to delayed or failed delivery are not affected by these Terms.
12. Responsibility for Goods During Delivery
We are responsible for goods until they are delivered to you, or to another person identified by you to receive them.
Risk in the products passes to you when the products come into your physical possession or the possession of the person you nominate to receive them.
Different rules may apply where you independently arrange a carrier that we have not offered as a delivery option.
If a parcel is lost or damaged before delivery, please contact us and we will investigate the matter with the carrier.
Your contract is with Earthing Revolution Ltd. You will not normally be required to pursue the delivery company yourself in order to exercise your consumer rights against us.
13. Your Right to Cancel an Online Order
If you are purchasing as a consumer, you will normally have the legal right to cancel your online order without giving a reason.
For most goods, the cancellation period expires 14 days after the day on which you, or someone nominated by you, receives the goods.
Where an order contains multiple goods delivered separately, the cancellation period will normally begin when the final item is received.
To exercise your cancellation right, you must clearly inform us that you wish to cancel.
You can contact us at:
info@earthingrevolution.co.uk
You may also use any cancellation or returns procedure made available through our website.
You then normally have a further 14 days to return the goods.
14. Exceptions to the Right to Cancel
The statutory cancellation right does not apply in certain circumstances prescribed by law.
These may include, where the relevant legal conditions are satisfied:
- goods made to your specifications or clearly personalised;
- goods which are liable to deteriorate or expire rapidly;
- sealed goods which are not suitable for return for health protection or hygiene reasons where the seal has been broken after delivery.
- We will not rely on a hygiene exception unless the circumstances of the product and its packaging meet the relevant legal requirements.
Any product-specific restriction will be made clear before purchase where applicable.
Your rights regarding faulty, damaged or misdescribed goods are separate and are not removed by these exceptions.
15. Returning Cancelled Orders
Where you exercise your statutory cancellation right, you must take reasonable care of the products while they are in your possession.
You may inspect products to the extent reasonably necessary to establish their nature, characteristics and functioning, similar to the way you would normally be able to inspect them in a physical shop.
We may be entitled to make a deduction from your refund if the value of the goods has been reduced because they have been handled beyond what is reasonably necessary.
Unless we state that we will pay the return cost, you will normally be responsible for the direct cost of returning goods where you simply change your mind.
Please see our Returns & Refunds Policy for return instructions.
16. Refunds Following Cancellation
Where you validly cancel an order under your statutory cancellation rights, we will refund the payments due to you in accordance with applicable consumer law.
This will normally include the original standard delivery charge.
If you selected a more expensive delivery method than our least expensive standard delivery option, we are not required to refund the additional delivery cost.
We will normally make the refund within 14 days of receiving the returned goods or, where applicable, receiving satisfactory evidence that the goods have been sent back.
Refunds will normally be issued using the original payment method unless otherwise agreed.
Our Returns & Refunds Policy may provide additional rights beyond your statutory rights.
17. Faulty, Damaged or Misdescribed Goods
The Consumer Rights Act 2015 provides consumers with legal rights in relation to goods.
Products supplied by us must be:
- of satisfactory quality;
- fit for their usual purpose and any particular purpose made known to us where applicable;
- as described; and
- otherwise compliant with applicable consumer law.
If a product is faulty, damaged, unsafe, misdescribed or otherwise does not conform to the contract, you may be entitled to remedies including a refund, repair, replacement or price reduction depending on the circumstances and the time that has passed.
In appropriate circumstances, consumers have a short-term right to reject non-conforming goods within 30 days.
These statutory rights are separate from, and additional to, any commercial guarantee or extended returns period that we choose to offer.
Nothing in these Terms or our Returns & Refunds Policy limits your statutory rights.
18. Manufacturer Guarantees
Some products may be supplied with a manufacturer's guarantee or warranty.
Any such manufacturer's guarantee is in addition to, and does not replace or restrict, your statutory consumer rights against Earthing Revolution Ltd as the retailer.
Please contact us if you require information regarding a manufacturer's warranty supplied with a product.
19. Product Reviews and Customer Content
We may allow customers to submit product reviews, photographs, testimonials, comments or other content.
Reviews and testimonials must reflect genuine experiences and must not be false, misleading or fabricated.
You must not:
- submit a review for a product you have not genuinely used or purchased where the review implies otherwise;
- impersonate another person;
- submit misleading information about your experience;
- submit content that is unlawful, defamatory, abusive or infringes another person's rights;
- submit fake reviews on behalf of another person or business.
Where we invite or incentivise a review, we will require the review to remain genuine and will clearly disclose the incentive where required.
We may take reasonable and proportionate steps to detect, prevent and remove fake or misleading reviews.
We may moderate or remove content that breaches these Terms, but we will not remove a genuine review merely because it expresses a negative opinion about our business or products.
By submitting content to us, you grant us a non-exclusive, royalty-free licence to display and use that content in connection with our business and marketing, subject to applicable privacy, advertising and consumer-protection law.
20. Intellectual Property
Unless otherwise stated, the content of this website is owned by or licensed to Earthing Revolution Ltd.
This includes, where applicable:
- text;
- graphics;
- photographs;
- videos;
- logos;
- branding;
- website layout;
- original educational content.
You may view and use the website for your own personal, non-commercial purposes.
You may not reproduce, distribute, commercially exploit or republish our protected content without permission except where permitted by law.
Third-party trademarks, product names, photographs and other intellectual property remain the property of their respective owners.
21. Third-Party Websites and Services
Our website may contain links to third-party websites or use services supplied by third parties.
These may include payment providers, review platforms, social media platforms, analytics services and other ecommerce services.
We are not responsible for the independent content, availability or privacy practices of websites that we do not control.
A link to a third-party website does not necessarily constitute an endorsement of everything on that website.
Your use of third-party services may also be subject to their own terms and privacy policies.
22. Privacy and Personal Information
Our collection and use of personal information is governed by our Privacy Policy.
We use personal information for purposes including processing orders, delivering products, providing customer support, preventing fraud and operating our website.
Where required, we will seek appropriate consent before using information for marketing purposes.
Please review our Privacy Policy for further information about how we process personal data and your rights.
23. Website Availability
We aim to keep our website available and functioning correctly but cannot guarantee uninterrupted access at all times.
We may temporarily suspend or restrict the website for:
- maintenance;
- security;
- technical improvements;
- circumstances outside our reasonable control.
We are not responsible for temporary website interruptions where we have taken reasonable care and the interruption does not breach a legal obligation owed to you.
24. Events Outside Our Reasonable Control
We will not be responsible for delay or failure to perform an obligation where this results from circumstances outside our reasonable control.
Examples may include severe weather, natural disasters, industrial disputes, carrier disruption, war, civil emergency, government action, major network failure or other exceptional events.
Where such an event affects your order, we will take reasonable steps to reduce the effect of the disruption and will contact you where appropriate.
Nothing in this section removes any statutory right you may have to cancel an order or receive a refund where required by law.
25. Our Liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so.
In particular, we do not exclude or limit liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of your statutory consumer rights;
- defective products where liability cannot legally be excluded;
- any other liability which cannot lawfully be excluded or limited.
If you are purchasing products as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
We supply products for personal and domestic use unless expressly stated otherwise. If you use a product for commercial, business or resale purposes, different rules may apply.
Nothing in this section affects your statutory consumer rights.
26. Business Purchases
If you purchase from us wholly or mainly for business purposes rather than as a consumer, some consumer protections referred to in these Terms may not apply.
Where you purchase as a business, you confirm that you have authority to bind the business on whose behalf you place the order.
Any specific business-to-business agreement entered into separately with us may take precedence over these consumer-facing Terms.
27. Refusing or Cancelling Orders
We may refuse or cancel an order where we have a legitimate reason to do so, including where:
- a product is unavailable;
- there is an obvious pricing or description error;
- payment cannot be authorised;
- we cannot deliver to the destination;
- we reasonably suspect fraud or misuse;
- accepting the order would breach applicable law.
If we cancel an order after receiving payment and you are entitled to a refund, we will refund the relevant amount.
28. Complaints
If you are unhappy with a product or our service, please contact us so that we can try to resolve the issue.
Email: info@earthingrevolution.co.uk
Telephone: 0208 037 7792
Please include your order number and sufficient information for us to investigate your complaint.
Nothing in our complaints procedure prevents you from exercising any rights available to you under applicable consumer law.
29. Changes to These Terms
We may update these Terms from time to time to reflect:
- changes in the law;
- regulatory requirements;
- changes to our products or services;
- changes to the way our website operates;
- security or technical requirements.
The version applying to an order will normally be the version in force when that order was placed.
Any updated version will be published on our website together with an updated revision date.
Changes will not retrospectively remove statutory or contractual rights that have already arisen.
30. Severability
If any part of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.
The remainder of these Terms will continue to apply.
31. No Waiver
If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.
32. Entire Agreement
These Terms, together with the policies and information expressly incorporated into them, form the agreement between you and Earthing Revolution Ltd relating to your use of our website and purchases from us.
Nothing in this section excludes liability for fraud or prevents a consumer from relying on statements or information that they are legally entitled to rely upon.
33. Governing Law and Jurisdiction
These Terms and any contract between you and Earthing Revolution Ltd are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply where you live.
If you live in England or Wales, the courts of England and Wales will normally have jurisdiction.
If you live in Scotland, you may normally bring proceedings in Scotland.
